The Heath and Safety Executive have fined Dudley Metropolitan Council after failing to comply with multiple safety acts, resulting in the death of a worker. In total Dudley Council was fined £50,000 after pleading guilty to breaching the Health and Safety at Work Act.
Geaorge Pagett a general manager for the council was killed after being stuck in the back by a wheeled shovel loader and then was crushed as the front wheel ran over his body. The worker at fault for this accident, Michael Lilley had been driving the vehicle against the stated one-way system as well as loading the vehicle in such a way that his vision was obstructed. This meant that he had not taken the correct precautions to avoid damaging other workers, even though Mr Pagett was wearing a high visibility jacket, as required.
David Price, an inspector for the HSE said: "This was a terrible incident that could so easily have been prevented. Mr Pagett's untimely death has brought great grief to his family, and to many of his work colleagues. Employers need to provide set routes, to keep pedestrians and vehicles safely apart. They also need to check their site rules and systems of work are both appropriate and adequately enforced."
